Basic: Limited feature set for break rooms and other common areas.

Conference: Limited feature set for conference room applications.

Enhanced: Includes dozens of productivity-enhancing features.

Premium: Includes all enhanced features, plus mobility features and web-based control.

The SEAT Types and Minute Plans defined in this section have been discontinued. These SEATs are no longer available for purchase for new installations and are only available for existing deployments.

Payphones: $1.00 per call for toll-free calls from payphones

Short Duration Calls: Nitel reserves the right to charge a full 60 seconds for excessive short duration calls. The number of short duration calls is considered excessive when greater than 10% of calls within a monthly billing cycle last less than 6 seconds.

Restoration of Service Fee: $500, payable when balance is cleared.

Move, Add or Change to Original Local Number Portability (LNP) Order: $50

Non-IP Originated Traffic: Nitel reserves the right to charge an incremental $0.08 per minute for traffic considered to be Non-IP originated.

Cancellation before Service Activation Fee: Customer agrees to pay a cancelation fee of $2,000 plus any additional costs Nitel incurs from its underlying carriers if Customer cancels Services before Start of Service Date. This applies only to n-Tellivoice services.

Change Order: Service will be provisioned according to the location information and technical specifications detailed on this order form.  Changes and modifications to this information must be submitted in writing to orders@nitelusa.com referencing your Nitel provided Order Number.  Each change will incur a $500 Design Change Fee per location.

Requested Due Date Changes: Changes to your Requested Due Date must be submitted in writing to provisioning@nitelusa.com referencing your Nitel provided Order Number.  Each change will incur a $500 Due Date Change Fee per location.  Please see Section 4 of your MSA for more information.

RBOC/Non RBOC Termination: Nitel requires that 80% of your traffic terminates in Regional Bell Operating Company (RBOC) territories. Should the non-RBOC termination rate exceed 20%, Nitel will rate all non-RBOC calls in excess of 20% at $0.15 per minute

International Rates: Full international rate schedule can be found here.

Rates to AK and HI: Calls to Alaska and Hawaii are not included in minute bundles.  Rates can be found in the international rate schedule.

Rates to US Territories: Calls to American Samoa, Guam, Northern Mariana Islands, Puerto Rico and US Virgin Islands are not included in minute bundles.  Rates can be found in the international rate schedule.

Availability: Domestic LD plans are available in the continental United States. Domestic LD minutes are for use in the continental United States only.

Incorrectly Provisioned 911 call: Clients will incur a $350 charge per occurrence for 911 emergency services calls from a number not provisioned and set up with Nitel during the install and setup process

Directory Assistance: Calls to directory assistance are charged $1.50 per call

Move, Add or Change to Trunk, DID, Toll Free, Analog Line, or Fax Line orders: $50

Cancellation of DID, Toll Free, Analog Line or Fax Line orders: $25 per Telephone Number

Expedited LNP Cancellation (within 48 hours of FOC): $100 per telephone number

The minimum call duration for billing purposes is: (a) for Voice Services in the continental US and Canadian provinces, six (6) seconds minimum initial period and usage is rounded to the next higher six (6) second increment after the initial period; (b) for international Voice Services (for only those international routes offered by Nitel) EXCEPT Mexico, six (6) second minimum initial period and usage is rounded to the next higher six (6) second increment after the initial period; and (c) for Voice Services to and from Mexico, sixty (60) seconds minimum initial period and usage is rounded to the next higher sixty (60) second increment after the initial period.

Fair Usage

UNLIMITED LOCAL CALLING

Unlimited local calling is limited to 70% of the total call volume of local and domestic LD calling.  All usage over 70% of the total call volume will first be tracked against domestic LD minute bundles at a ratio of 7 to 3.  If minutes provided in the domestic LD minute bundle are exhausted, additional usage will be billed at 7/3 of the customer’s domestic LD per minute rate.

UNLIMITED HOSTED OUTBOUND CALLING

Unlimited hosted outbound calling is limited to 1000 outbound off-net minutes per hosted seat.  Minutes are pooled among hosted seats at the same service location.  An individual seat may go over 1000 outbound off-net minutes but the aggregate outbound off-net minutes from all seats may not exceed the total outbound off-net minutes pooled.  Any overages will be billed at Nitel’s standard per minute rate, currently $0.039 per minute.

SHORT DURATION CALLS

Professional Installation

Nitel On-site Installation Specifications and Pricing

Professional Installation is included for all Nitel Voice Services. Nitel’s authorized installation contractor will perform the work. Nitel recommends that Customer order a Nitel site survey to identify potential obstacles to installation, and to preclude the possibility of unexpected installation delays and additional costs to the Customer.  Nitel will perform an onsite survey at the time of the first install appointment; however, this may delay your service activation date.

1.   Nitel Professional Installation includes the following:

a.   Install and test connectivity of an appropriate surface mounted wall jack to the Nitel provided CPE.

b.   Install Nitel provided CPE (shipped to the Customer’s Service Location before the installation):

i.   Mount the CPE to the appropriate rack or surface

ii.  Power up the hardware.

iii. Verification of Layer 2 and Layer 3 connectivity.

c.   Test connectivity from the Customer’s Service Location to Nitel’s Core Network.

d.   Nitel Turn-Up personnel ping the WAN interface of the Nitel provided CPE.

i.   Demonstrate connectivity to local contact and obtain signed acknowledgement from Customer’s authorized representative.

e.   Leave an unplugged 6-foot Ethernet cable next to the installed CPE or inside the CPE packaging materials. Customer may use this cable to connect the Nitel CPE to a Local Area Network device.

f.   If Nitel cannot complete a Professional Installation, notwithstanding Layer 2 or Layer 3 connectivity issues caused by Nitel provided CPE and/or Nitel network elements, Customer will be billed for the attempted installation using the Truck Roll charges outlined in the Non-Recurring Charges table below, and for any additional time and materials required to complete the installation at the rates listed in the Non Recurring Charges table or in the Service Order Form.

2.   Materials for Professional Installation. Professional installation includes minor materials required to turn up the Service (such as single in-line filters or couplers), but does not include major additional materials (such as conduit or NID splitters). If Customer stops the installation for any reason that requires an AUTHORIZED INSTALLATION CONTRACTOR to return to the site to complete the installation, additional truck roll charges will apply. For this reason, Nitel recommends that customers with non-standard arrival requirements (such as restaurants with busy periods or retail establishments with hours outside 8AM to 5PM local time) discuss this with Nitel at the beginning of the installation process.

If the AUTHORIZED INSTALLATION CONTRACTOR fails to arrive or does not have the necessary materials to complete installation as defined, Nitel will reschedule installation and Customer will not be charged for the missed installation attempt.

In the event that Professional installation is insufficient for Customer’s installation requirements, and Nitel cannot transition to Custom installation during the Professional installation truck-roll, Nitel may, at its discretion, attempt to meet expanded requirements through time and materials charges (for example, installing extra wiring).

3.   Additional Installation Requirements.  For Customers with installation needs outside the scope of Professional installation, any custom installation work must be handled by the Customer’s Vendor or discussed and authorized with Nitel’s Authorized Installation Contractor.

4.   Limitations on Installation Services. The following installation activities are never provided by Nitel:

a.   Drilling through masonry or exterior walls.

b.   Installing wiring in attics or crawl spaces.

c.   Wiring externally to the suite or building, including drilling from the outside of a building to the inside of a building.

d.   Installing wiring through multiple floors or from a DMARC to a suite in a multi-tenant unit (MTU).

e.   Accepting or utilizing site surveys provided by the Customer or from a third party.

f.   Installing wiring or equipment in a location or manner that in Nitel’s reasonable opinion would create a safety hazard including work in, above, or near food preparation areas.

5.   Customer’s Pre-Installation Obligations for Installation.

a.   For All Installation. Customer shall provide Nitel’s authorized installation contractors with access to all areas necessary to complete the installation. Prior to the scheduled installation date, Customer shall:

i.   Obtain any licenses, approvals, and permissions required by a landlord, building manager, or governmental authority for the installation and meet any insurance requirements related to the installation;

ii.  Identify Service locations potentially outside the scope of Professional installation or Custom installation as defined in the Customer’s Technical Requirements Agreement, as additional costs may be incurred, including charges for a second installation if work cannot be performed within the scope during the first scheduled installation; and

iii. For any Service location in a mall or other multi-tenant unit (MTU), Customer shall arrange for the use of tie pairs/facilities extending from the local telephone company demarcation point (DEMARC) to a common location within Customer’s store or leased space at the Service location. If no such pairs/facilities exist, Customer is responsible for their installation and clear identification of appropriate facilities for use prior to the date scheduled for Installation. If facilities are not ready, Customer may be charged for an additional installation truck-roll and any other related charges.

6.   Installation Schedule.   In the absence of an amendment to this Agreement that establishes a schedule for installing the provisionable Service locations ordered by Customer, or network elements that delay the installation project such as construction, network equipment augmentations or other, the Parties shall work in good faith to promptly schedule the installation of ordered Service so all provisionable Service locations are scheduled for installation to be completed within ninety (90) days of the date on which Customer delivers this executed Agreement and associated Service Orders to Nitel. Those locations that do not meet this scheduling deadline due to Customer scheduling issues will not be eligible for any Nitel promotions and may be subject to Cancellation Fees.

Installation is scheduled after the circuit is delivered to the DMARC (“Basic Installation”) and Nitel ships the CPE to Customer, if applicable. For Professional Installation, Nitel provides a four (4)-hour window for the arrival of the AUTHORIZED INSTALLATION CONTRACTOR and requires Customer to have a local contact on-site for the duration of the installation. This local contact must be authorized to sign the Nitel work order verifying installation completion. If Customer requires a specific arrival time, an arrival window outside 8AM to 5PM local time, or installation verification from an off-site contact, Customer may be subject to additional charges.
